对共享经济中消费者权益保护之反思
目的/意义共享经济改变了社会经济的发展方式共享经济的消费者,越来越多的分享式交易出现在生活中。但新的交易方式无不挑战着消费者权益,引发了共享经济对消费者权益冲击的反思。设计/方法在对相关政策和实践作出梳理与分析后,发现市场准入监管缺失、用户安全遭遇威胁、共享企业间的不正当竞争、消费者维权难是共享经济对消费者权益冲击的主要表现。结论/发现共享经济作为一种新的经济模式,在我国还未发展成熟,尤其在消费者权益保护方面更显苍白。为充分应对挑战共享经济的消费者,或可通过构建共享原则、明晰合同义务、明确侵犯用户信息的赔偿标准、宣传共享理念等,兼顾内部约束和外部监管,实现新时代经济发展和消费者保护的共赢。

[Purpose/Significance] The sharing economy has changed the way of socioeconomic development, and more and more sharing transactions appeare in life。 The new transaction methods all challenged consumer rights and interests, and triggered a reflection on the impact of the sharing economy on consumer rights。 [Design/Methodology] After sorting out and analyzing relevant policies and practices, it was found that lack of market access supervision, user security threats, unfair competition among sharing enterprises, and difficulty in consumer rights protection are the main manifestations of the impact of the sharing economy on consumer rights。
[Findings/Conclusion] As a new economic model, the sharing economy has not yet matured in our country, especially in terms of protecting consumer rights and interests。 In order to fully meet the challenges, it is possible to achieve a win-win situation for economic development and consumer protection in the new era by constructing sharing principles, clarifying contractual obligations, clearing compensation standards for violation of user information, and promoting sharing concepts, and taking into account internal constraints and external supervision。
